I am new to the Iphone, I bought an iPhone and it may be jailbroken, when i go to the apple store Icon it takes me to menu for download stuff.

Just a couple of newbie questions

1. Is this sound like it's Jailbroken?
2. If I install iTunes will it force me to update my firmware and therefore locking my phone?
3. How to customize Text alerts and ringtones?

Yes it is jailbroken and the App Store icon is probably pointing to installer.
iTunes will not force you to upgrade, it will ask you and you can select 'No', but if you update it will relock your phone.
Ringtones can be customized by having ACC music files and changing the extention to .m4r and using iTunes to sync.
For the text alerts you will have to SSH into your iPhone and put the sould files into the text alerts folder \Library\Ringtones
You can do this using Wi-Fi and then using SFTP or FTP client to connect to your phone.
You would want you text alert to be small duration as it will take lot of battery
